Magistrate Dolphina Alego said evidence presented by the prosecution cast serious doubt on the authenticity of documents used to support Davis Chelogoi's ownership claim.

Former Nairobi Provincial Commissioner (PC) Davis Nathan Chelogoi has been convicted of five offences in a Sh1.3 billion land fraud case involving a 7.39-hectare parcel in Lower Kabete, following a court finding that he failed to prove his claim to the disputed property.

Principal Magistrate Dolphina Alego ruled that the prosecution had established its case against Chelogoi beyond reasonable doubt, relying on testimony from 19 witnesses, including officials from the State Department for Lands and Physical Planning.

However, the court acquitted his co-accused, former Assistant Deputy Director of Lands Administration Andrew Aseri Kirungu, after finding insufficient evidence to prove that he knowingly participated in the alleged fraud.
