Milimani court awards musician Nonini Sh2.5 million in general damages and Sh500,000 in aggravated damages, ordering Mutua to delete the disputed posts within 14 days.

Former Kenya Film Classification Board (KFCB) chief executive Ezekiel Mutua has been ordered to pay musician Nonini Sh3 million in damages after a Nairobi court found him liable for defamation over remarks he made about the artist on social media.

Milimani Commercial Magistrate James Gitau awarded Nonini, whose real name is Hubert Mbuku Nakitare, Sh2.5 million in general damages and an additional Sh500,000 in exemplary and aggravated damages in a judgment delivered on October 26, 2026.

The court also ordered Mutua to delete the disputed statements from his social media account within 14 days and pay the costs of the suit.

In his judgment, Magistrate Gitau found that Mutua's remarks had the potential to damage the musician's reputation by creating the impression that he had fled Kenya to evade the law.

“The remarks had the potential to undermine the musician’s reputation,” the court held, according to the judgment.

The Sh3 million award comprises compensation for the reputational harm suffered by Nonini, as well as exemplary and aggravated damages, which account for the additional harm arising from the defamatory remarks.

Beyond the financial penalty, Mutua must remove the offending statements within the 14-day deadline and meet the legal costs incurred by the musician in pursuing the case.

The ruling marks a legal setback for the former KFCB boss, whose social media comments about Nonini formed the basis of the defamation lawsuit.
