Wanyonyi’s lawyer, Allan Mulama, asked PricewaterhouseCoopers LLP (PwC) to provide a certified copy of the forensic audit report completed in September 2024 concerning KUSCCO Limited.

The High Court has directed petitioner Simiyu Robert Wanyonyi to obtain a forensic audit report on the Kenya Union of Savings and Credit Co-operatives Limited (KUSCCO) as a key document in his constitutional petition challenging the SACCO sector regulator and other parties.

In a letter dated October 14, 2026, Wanyonyi’s lawyer, Allan Mulama, asked PricewaterhouseCoopers LLP (PwC) to provide a certified copy of the forensic audit report completed in September 2024 concerning KUSCCO Limited.

The request follows directions issued by Lady Justice R.E. Aburili on October 12, 2026, requiring the petitioner to obtain the report within 14 days.

The petition, filed as Constitutional Petition No. HCCHRPET/E443/2026, is pending before the High Court’s Constitutional and Human Rights Division in Nairobi.

Wanyonyi argues that the audit report is central to the determination of the case and that the court needs the document to assess the claims presented against the respondents.

In the letter to PwC, Mulama said the court could not properly examine the report’s contents or authenticity without the actual document.

“Without the production of the document, the Court cannot assess its form, content, or authenticity,” the lawyer stated.

He added that the absence of the report left the court with allegations that should be supported by documentary evidence.

“The Court made this direction because the report is central to the determination of the Petition,” the letter stated.

Mulama said the matter was urgent because the court had set a 14-day deadline for obtaining the audit report.

The lawyer asked PwC’s country senior partner to facilitate the release of a certified copy of the document, which could help establish the evidential basis of the petition.

The letter identifies KUSCCO Limited by its co-operative registration number CS/S/2.

The petition names the SACCO Societies Regulatory Authority and three other respondents alongside the petitioner.

The court’s determination will depend on the issues raised in the petition and the evidence presented by the parties. The contents of the forensic audit report and the specific findings challenged by the petitioner were not detailed in the letter.

The court’s October 12 directions set the process in motion to secure the report, with the petitioner required to obtain it within the stipulated period.
