A bus driver has been charged with causing the deaths of two Technical University of Mombasa (TUM) students in a road accident in Awasi, Kisumu County, that also left 10 other passengers injured.
According to a statement by the Director of Public Prosecutions (DPP), the driver faces 12 counts, including two counts of causing death by dangerous driving and 10 counts of driving without due care and attention.
Jotham Murumba Wanjala appeared before Nyando Senior Principal Magistrate Evelyn Makungu Onzere, where he denied all the charges.
"The prosecution charged Wanjala with two counts of causing the deaths of passengers by dangerous driving, contrary to Section 46 of the Traffic Act, Cap. 403, Laws of Kenya," the statement said.
The driver also faces 10 counts of driving without due care and attention, contrary to Section 49(1) of the Traffic Act, arising from injuries sustained by 10 passengers in the accident.
The prosecution, led by Principal Prosecution Counsel Douglas Moseti, told the court that the accused drove the bus at a speed and in a manner that endangered the public before losing control of the vehicle.
The bus allegedly veered off the road, resulting in the fatal accident and injuries to the other passengers.
The incident is believed to have occurred on August 7, 2026, in the Boya area along the Ahero–Awasi Highway in Nyando Sub-County, Kisumu County.
"The court granted the accused a bond of Sh500,000 without an alternative cash bail option," added the statement.
The case will be mentioned on November 5, 2026, for further directions.
The charges are allegations, and the accused is presumed innocent unless proven guilty by a court of law.
