However, the prosecution urged the court not to release him, arguing that his previous conduct in court raised concerns about his willingness to attend trial.

The State told the court that Musyoka had previously been charged with a similar offence at Makadara Law Courts but repeatedly failed to attend court, resulting in warrants of arrest being issued against him.

“Your Honour, the accused absconded from court in Makadara Criminal Case E5813 of 2024, and subsequently a warrant of arrest was issued against him,” the prosecution told the court.

The prosecution further informed the magistrate that it had copies of the warrants, which were attached to an affidavit sworn by the investigating officer.

According to the investigating body, the earlier case, Republic v Cyrus Kisavi Musyoka, was withdrawn after he allegedly absconded.

The matter was subsequently reinstated in 2025 under case number E2893 of 2025, but the prosecution claims he again failed to attend court and remained at large until his latest arrest.

Musyoka was arrested on October 22, 2026, and has been in custody for seven days following an earlier order by Principal Magistrate Paul Mutai allowing investigators time to conduct further investigations.
