The Communications Authority of Kenya (CA) has directed mobile network operators to temporarily exempt government-authorised emergency bulk SMS messages from opt-in and opt-out requirements during the National Early Warning System simulation exercise and the El Niño preparedness and response period.
In a directive to Safaricom, Airtel, Telkom, and Jamii Telecommunications, the Authority said the exemption would help disseminate critical public safety information to Kenyans on time.
The directive covers test runs scheduled for October 2, 2026, as well as early warning messages, disaster preparedness advisories, simulation notifications and emergency alerts related to El Niño.
Under the directive, operators are required to deliver approved emergency SMS messages to all active subscribers, regardless of their promotional messaging preferences, Do-Not-Disturb settings or previous opt-out arrangements.
The Authority has also instructed operators to refrain from applying opt-out mechanisms to emergency alerts, prioritise emergency communications to ensure timely delivery, and provide the technical support necessary for simulation exercises and actual emergency response operations.
The messages are to be disseminated through designated government platforms, including Short Code 1590.
The CA said the directive was issued in the public interest and forms part of the government’s obligation to safeguard life, property and national security through the timely distribution of essential information.
It cited Articles 35, 33 and 46 of the Constitution of Kenya, alongside the Access to Information Act, 2016, as the legal basis for disseminating information affecting public welfare and safety.
The Authority further referenced operators’ licensing obligations, which require them to coordinate with relevant government agencies and provide necessary services during emergencies or crises.
Compliance with the directive is mandatory, with operators required to implement the necessary technical and operational measures immediately and submit updates on their preparedness status.
