The petitioner contends that the National Assembly had no constitutional authority to consider and approve the draft regulations before they were enacted and published in the Kenya Gazette by the SRC.

A petitioner has moved to the High Court in Nairobi seeking to suspend the implementation of new regulations governing the remuneration and benefits of State and public officers, arguing that Parliament acted beyond its constitutional mandate in approving the rules.

Eliud Karanja Matindi wants the court to declare Section 26(2) of the Salaries and Remuneration Commission (SRC) Act unconstitutional and invalidate Legal Notice No. 106 of 2026, which was published in the Kenya Gazette on June 19, 2026.

In his petition, Matindi argues that the law gives the National Assembly powers to interfere with the independence of the SRC, a constitutional commission mandated to determine the remuneration and benefits of State and public officers.
