Matatu driver who pulled Manyoka stunt in crash that killed three to remain in custody
The prosecution alleges that he was driving minibus registration number KDU 887C along Enterprise Road near KCB Bank at about 8:oo pm when the crash occurred.
A matatu driver accused of pulling a “manyoka” stunt before a crash that killed three passengers along Enterprise Road will remain in custody after a Nairobi court declined to review his bail status.
Magistrate Paul Mutai rejected an application by Sammy Murigi Maina to reconsider his continued detention, ruling that he would remain behind bars until key prosecution witnesses testify.
Maina is accused of causing the June 3, 2026 crash involving an Isuzu minibus operated by Risen Sacco that left three people dead and others injured.
The court expressed concern over the slow progress of the trial, with only one witness appearing for the hearing, but maintained that the delay should not prejudice the proceedings.
The prosecution was directed to ensure eyewitnesses attend court to testify and investigate allegations that the investigating officer was frustrating the hearing.
The victims had raised concerns over the officer’s conduct, prompting calls for the officer to appear in court and explain the alleged interference with the progress of the case.

In his application, Maina argued that he was suffering in custody and urged the court to reconsider the decision to deny him bail. However, Mutai said he was not persuaded to review the decision at this stage.
The case will be mentioned on November 9, when the prosecution is expected to proceed with its witnesses.
Maina was arrested nearly two months after the crash and charged with three counts of causing death by dangerous driving, contrary to Section 46 of the Traffic Act.
